as far as I'm aware if you haven't had 2 verbal warnings and a written warning your work couldn't put it in your reference anyway that you were late if they didn't show they'd taken official steps to try stop it. If they do so you can take legal action against them.
It's the same with most things like that, the exceptions being obv. things that fall into the catagory of insubordination and gross misconduct 9 ie instantly sackable offences) .
