I do somewhat agree with that, but if a car is driving directly at you, with the intention of running you over your going to panic and fire like hell to avoid getting killed.

I would class intentionally killing somebody by running them over as a lethal threat. I do get what you mean by don't shoot unless in response, but there are plenty of other life threatening situations where by that logic you wouldn't be able to use a firearm - said car running over, somebody pulls a knife, bat, etc.
All that logic would end up with his more dead cops.
