I got £20 of my £40 charge back a couple of weeks ago with a letter tha basically said "we don't need to pay you this back and we're just doing it to shut you up so we suggest you dont take it any further or WE WILL OWN YOU"
Needless to say im leaving i at that.

Not quite; you're perfectly able to make a claim: there's no definitive ruling as to whether (and under what circumstances) you'll be successful.
The 5/6 years is down to how long they have to retain your data for. They're not going to refund any charges made ten years ago if they don't have any records of your account from back then.
They've said I'm not getting anything, a few websites have said this happens and to batter off another letter which I'll be doing today.
I've been using the letters from Govan Finance centre, if I don't get any decent reply then I'll have a swatch at the consumer action group.
The Govan Law Centre ones are really good, more info on the CAG though.
