Depends where you're pitching the tent. I mean the whole trespass law in Scotland's a bit blurry so you should be good. If it's on a street you might get moved along but not lifted. In a field or that just check it's not a farmers land although they don't mind if you drop them a tenner and mind to shut the gate behind you.
Watching people while you do it makes no difference to the legality.
