| Season 4: Episode 5. 
Tonight's episode: Sayid and Desmond hit a bit of turbulence on the way to the freighter, which causes Desmond to experience some unexpected side effects. Catch-up: Jack and Juliet return to the beach camp with Charlotte and Daniel. Jack attempts to contact the freighter, but gets no response. Eventually they turn to Charlotte who contacts the freighter via an emergency channel and they learn the helicopter never arrived at the freighter despite it leaving the day before. At the barracks, Kate frees Miles so he can talk to Ben in exchange for everything Miles knows about Kate. Miles demands $3.2 million from Ben in exchange for telling his employers that Ben is dead. Kate learns the people on the freighter know she's a fugitive. Her actions result in Locke banishing her from their group. Kate believes she isn't pregnant; Sawyer is elated at the news, but Kate isn't as enthusiastic after speaking earlier with Claire who suggested she'd be a good mother. She decides to go back to the beach camp and slaps Sawyer after he tells her she'll come running back in a week after finding a reason to get pissed off at Jack. Meanwhile, IN THE FUTURE, Kate goes to trial for her crimes. Jack is brought in as a character witness, telling the jury that Kate saved his life when Oceanic 815 crashed just offshore of a deserted island in the South Pacific as he was badly hurt and drowning. She then helped the five survivors of the crash with their wounds, find food and shelter, and tried to save the other two initial survivors of the crash. Kate has him stop as she knows it's all a lie. Her lawyer arranges a meeting with her mom who wants to see her grandson in exchange for not testifying. Kate refuses, but her mother still decides to not testify. With their star witness out for "medical reasons", the prosecution cuts a deal with Kate: no jail time, but ten years probation and she can't leave California. A free woman, Kate is met by Jack who would like to continue their relationship, but can't bring himself to see her son. Kate tells him that nothing can happen between them until he could get over that. Returning home, Kate greets her "son" Aaron, Claire's child.

I do actually have a theory. Penny's dad bought the Hanso diary, which may have details on the island. Penny's dad was the one who sent Desmond on the sailing trip if I remember rightly. After he disapeared, maybe Penny's dad told her about the island...
